Federal and State Laws Requiring Schools
to Provide Accommodations
The Individuals with Disabilities Act (IDEA), requires that children with disabilities are included in general State and district-wide assessment programs, with appropriate accommodations where necessary.
PL 94-142 Education of All Handicapped Children Act (1975). This law mandated that children with disabilities be educated in the least restricted environment.
Section 504 of the Rehabilitation Act of 1973. This act provides rights for students with a disability and includes those students who need assistance but are not otherwise eligible for special education services.
The Americans with Disabilities Act of 1990. This act prohibits discrimination against any persons with disabilities.
The State Board of Education Rule 6A.6.0312, FAC, Course Modifications, and Rule A-10943,FAC, Modifications of State Student Assessment Test Instruments and Procedures for Exceptional Students and Other Eligible Handicapped Students. Both Rules specify allowable accommodations and modifications for students with disabilities.
